Paid maternity leave

On 1 July 2005, the federal maternity insurance came into force. In principle, the provisions for working women provide maternity leave of 14 weeks at 80% of wages. (www.ch.ch/de/mutterschaftsurlaub) According to Art. 23 of the revised Ordinance on Loss of Earnings Compensation, entitlement to this compensation exists if a child is born viable or if the pregnancy lasted at least 23 weeks.
If the child is born before the 23 + 0 gestational week, there is no entitlement to maternity leave.

Puerperant women are not allowed to work for 8 weeks after giving birth (Art. 35a (3) of the Employment Act (EmpA)). Even when the maternity insurance comes into effect, it is possible for an employer to provide better benefits. For this, the employment contract and the respective applicable regulations and terms are to be consulted.
